**FOR INTERNAL DIRECT CARE SERVICES ONLY** The course is intended for all senior staff working in any social care commissioned service setting (including nurses working in these settings or frontline staff looking for continued professional development).

Learning Outcomes

  • Understand the relationships between MCA, DoLS and Human Rights
  • Be able to Identify the principles, duties and responsibilities under the Act and how it relates to health/social care decisions in your service
  • Recognise what the Care Quality Commission expects from providers in relation to both the consent, the MCA and DoLS (including community DoL where it applies to your service.
  • Recognise your duties/responsibilities regarding consent
  • Recognise how the MCA principles apply to health/care decisions
  • Know how to involve and support people in decision-making and evidence this in your care plans
  • Explain the ‘decision/time specific’ nature of mental capacity
  • Be able to complete, record and evidence; capacity assessments and best interest decisions
  • Define the role of Independent Mental Capacity Advocacy service
  • Recognise what constitutes restraint/restriction and how these should be managed and evidenced in practice
  • Know how to evidence the legal arrangements that people have in place including; LPA’s, Advance Decisions, Deputies and Appointees
  • Understand the limits on power/control in health care settings
  • Recognise your legal responsibilities and practice implications in relation to deprivation of liberty
  • Be able to identify Restraints/restrictions and how this applies to deprivation of liberty (DoL)
  • Recognise what constitutes a DoL as per the ‘acid test’
  • Be able to apply the ‘acid test’ to identify a DoL in health and care settings
  • Understand how the processes for authorising a DoL in care homes, hospitals and in the community (where relevant to your service)
